PUBLIC OFFER AGREEMENT
Introduction
This document is an official proposal of the individual entrepreneur Vasylenko A.V. hereinafter referred to as the Seller, to conclude a contract for the purchase and sale of goods remotely, i.e. through the online store lookcharged.com.
In accordance with Articles 633, 641, 642 and 655 of the Civil Code of Ukraine, this document is a public offer addressed to an unlimited number of persons and has the same legal force for all buyers.
Acceptance of this offer is the fact of the Buyer placing an order on the Seller’s website.
1. General provisions
1.1. The Agreement regulates the relations between the Seller and the Buyer, who accepted the public offer for the purchase of goods presented on the website.
1.2. Acceptance of the offer is considered to be the Buyer placing an order on the website lookcharged.com.
1.3. By placing an order, the Buyer confirms his full agreement with the terms of this Agreement.
2. Terms and definitions
2.1. Online store — the Seller’s website lookcharged.com.
2.2. Product — products presented on the Seller’s website.
2.3. Order — a properly executed request by the Buyer to purchase the selected product.
2.4. Personal data — information provided by the Buyer when placing an order, necessary for identification and delivery.
3. Subject of the agreement
3.1. The Seller undertakes to transfer the ownership of the Product to the Buyer, and the Buyer — to accept and pay for it in accordance with the terms of this Agreement.
4. Ordering procedure
4.1. The Buyer places the order independently on the website.
4.2. The Seller is not responsible for errors made by the Buyer when placing the order.
5. Cost and payment procedure
5.1. The cost of the Goods is determined at the time of placing the order.
5.2. Payment is made using payment systems available on the site, or upon receipt (cash on delivery).
5.3. The cost of delivery is not included in the cost of the goods, unless otherwise specified when placing the order.
6. Delivery
6.1. Delivery is carried out by carriers (Nova Poshta or others) at the expense of the Buyer.
6.2. Delivery time: 1–10 business days, depending on the region and availability of the goods.
6.3. The risk of accidental damage or loss of the goods passes to the Buyer from the moment the goods are transferred to the carrier.
7. Return of goods
7.1. The Buyer has the right to return the goods within 14 days from the moment of receipt, in accordance with Art. 9 of the Law of Ukraine “On Protection of Consumer Rights”.
7.2. The goods must be new, in full condition, with packaging and documents intact.
7.3. In case of refusal of goods of inadequate quality, the cost is fully refunded.
8. Rights and obligations of the parties
The buyer undertakes:
- To familiarize himself with the terms of the contract before placing an order.
- To provide truthful data.
- To pay for and receive the order.
The seller undertakes:
- To transfer the goods in accordance with the terms of the order.
- To provide reliable information about the goods.
9. Force majeure
9.1. The parties are exempt from liability for failure to fulfill obligations in the event of force majeure circumstances, such as: war, natural disaster, blocking of transport, technical failures that make it impossible to fulfill obligations.
10. Dispute resolution
10.1. All disputes are resolved through negotiations, and in the event of failure to reach an agreement – in accordance with the procedure established by the legislation of Ukraine.
11. Protection of personal data
11.1. The Buyer agrees to the processing of personal data provided during the order process.
11.2. Personal data is processed solely for the purpose of fulfilling the terms of this Agreement.
12. Term of the Agreement
12.1. The Agreement shall enter into force from the moment of acceptance and shall be valid until the Parties have fully fulfilled their obligations.
12.2. The Seller has the right to unilaterally change the terms of the Agreement by publishing a new version on the website.
